Labor Market Impact Assessment (LMIA)
At Immigration Nation – Immigration Consultant Services in Edmonton, we understand the challenges faced by Canadian employers when hiring foreign workers. One of the key steps in hiring international talent is obtaining a Labour Market Impact Assessment (LMIA). As an employer, navigating the LMIA process can be complex and time-consuming, but it’s a necessary step to prove that no qualified Canadians or permanent residents are available to fill the role. With our expert guidance, we make the LMIA application process easier for you, ensuring compliance with government requirements while maximizing your chances of approval.
Whether you are seeking assistance for high-wage or low-wage positions, the Global Talent Stream, or hiring under the Temporary Foreign Worker Program (TFWP), our experienced immigration consultants in Edmonton are here to support you through every step of the LMIA process.
What is an LMIA?
An LMIA (Labour Market Impact Assessment) is a document that Canadian employers must obtain to hire temporary foreign workers. It is issued by Employment and Social Development Canada (ESDC) and acts as proof that there is a need for a foreign worker to fill a job. Additionally, it demonstrates that hiring a foreign worker will not negatively affect the Canadian labor market.
At Immigration Nation, we specialize in helping employers understand the different streams under which LMIA applications can be made, including the high-wage and low-wage streams, agricultural and caregiver streams, and the Global Talent Stream for skilled workers.
Types of LMIA Applications
1- High-Wage LMIA Employers offering wages above the provincial or territorial median hourly wage must apply under the high-wage stream. This stream involves stricter compliance obligations, such as the submission of a detailed transition plan to show how the employer intends to reduce reliance on foreign workers in the future.
Key Requirements for High-Wage LMIA:
- Job offer with a wage above the median wage for the province.
- Comprehensive recruitment efforts to hire Canadian citizens or permanent residents.
- A transition plan outlining how the employer plans to train or hire Canadian workers in the future.
2- Low-Wage LMIA Employers offering wages below the provincial median wage must apply under the low-wage stream. There are limitations on the number of low-wage temporary foreign workers that an employer can hire. Additionally, there are restrictions on employment duration and work hours.
Key Requirements for Low-Wage LMIA:
- Job offer with a wage below the median wage for the province.
- Evidence of recruitment efforts within Canada.
- Compliance with the 10% cap on low-wage foreign workers for companies with more than 10 employees.
3- LMIA for Skilled Workers If you need to hire foreign nationals for skilled positions, including managerial, professional, or technical roles, the high-wage stream can be used. These positions are classified under NOC TEER 0/1/2/3 and require extensive documentation of recruitment efforts and labor market conditions.
4- LMIA for Low-Wage Positions For roles that are classified as NOC TEER 4 or 5, an LMIA application can be submitted under the low-wage stream. This is suitable for positions in industries such as retail, hospitality, and some labor-intensive jobs.
5- Global Talent Stream (GTS) Designed to help employers hire highly specialized or in-demand workers, the Global Talent Stream allows employers to access skilled international workers in fields such as IT, engineering, and data science. The GTS offers faster processing times, with LMIAs being processed within 10 business days.
Key Requirements for Global Talent Stream LMIA:
- Employers must submit a Labour Market Benefits Plan showing how the hiring of foreign workers will benefit the Canadian labor market.
- A detailed referral form from a designated partner (for Category A positions).
- LMIA for Agricultural Workers The Agricultural Stream allows employers to hire foreign workers for seasonal jobs in farming, livestock care, and other primary agricultural work. Employers must ensure that job offers meet the National Occupational Classification (NOC) codes for primary agriculture.
LMIA Application Process
The LMIA process involves several steps that must be followed meticulously to ensure a successful outcome. Here’s an overview of the application process:
- Determine the Appropriate LMIA Stream The first step is identifying whether your job offer falls under the high-wage, low-wage, agricultural, or Global Talent Stream. Our consultants will assist you in choosing the right stream based on your industry, wage levels, and job requirements.
- Recruitment Efforts Before applying for an LMIA, you must demonstrate that efforts were made to hire Canadian citizens or permanent residents. This includes advertising the job in national and local job boards, using Job Bank, and meeting other recruitment standards set by ESDC. You must retain documentation of your recruitment efforts.
- Submit LMIA Application Once recruitment efforts are completed, we assist you in compiling and submitting the LMIA application to Service Canada. This includes ensuring that all supporting documents, such as job offers, business licenses, and financial statements, are in order.
- ESDC Assessment After submission, Employment and Social Development Canada will review the LMIA application to assess the impact hiring a foreign worker will have on the Canadian labor market. They will check if you’ve met all requirements, including wage offerings, recruitment efforts, and labor market needs.
- LMIA Decision Once the assessment is complete, ESDC will either issue a positive or negative LMIA. If positive, you can then forward the LMIA approval to the foreign worker, who will use it to apply for a work permit with Immigration, Refugees and Citizenship Canada (IRCC).
